Terms of Service

1. Acceptance of Terms
By creating an account or accessing any part of theark.ink or app.theark.ink("The Platform"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform. You must be at least 18 years of age to use the Platform.
2. What The Ark Is (and Is Not)
The Ark is an information and subscription platform. We provide:
- —Property listings with data, documents, and 3D media
- —Research and educational content about Patagonian land investment
- —Tools to facilitate connection between buyers, sellers, and agents
The Ark is NOT a licensed real estate broker, securities dealer, investment advisor, financial institution, or legal representative of any party in a transaction. Any land transaction is conducted directly between buyer and seller under Argentine law.
3. User Accounts
Registration. You must provide accurate information when creating an account. You are responsible for keeping your credentials secure.
Account tiers. Access to content is determined by your subscription tier (Free, Pro, Agent) as defined in the Subscription & Refund Policy.
Terms acceptance logging. By accepting these Terms, you consent to having the timestamp and version of your acceptance recorded in our database.
4. Subscriptions
Subscription terms, pricing, renewal, and cancellation are governed by the Subscription & Refund Policy. Payments are processed by Stripe, Inc. — The Ark does not store payment card data.
5. Content and Intellectual Property
Our content. All property listings, photos, 3D models, documents, research articles, and platform UI are owned by or licensed to The Ark. You may not reproduce, redistribute, or scrape any content without written permission.
Property data accuracy. Property information (area, zoning, FOS/FOT, price) is sourced from official documents and provided in good faith. It may not reflect the most recent cadastral or regulatory changes. Always conduct independent due diligence.
3D files. 3D Gaussian Splat files are for viewing purposes only. They are not engineering documents and do not constitute a survey, topographic plan, or architectural certification.
6. Prohibited Uses
You may not:
- —Use the Platform for any unlawful purpose
- —Attempt to reverse-engineer, scrape, or automate access to any Platform feature
- —Share your account credentials with others
- —Use the Platform to facilitate money laundering or circumvent Argentine foreign investment restrictions
7. KYC and Identity Verification
To access Tier 2 content, you must complete identity verification (KYC). By submitting identity documents, you consent to their secure storage and review as described in our Privacy Policy and KYC/AML Policy.
8. Disclaimers
THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. THE ARK DOES NOT WARRANT THAT any property is suitable for your intended purpose, any document or data is legally conclusive, any price or valuation is accurate or achievable, or that the Platform will be uninterrupted or error-free.

9. Limitation of Liability
To the maximum extent permitted by law, The Ark's liability for any claim arising from your use of the Platform is limited to the amount you paid for your subscription in the 12 months preceding the claim.
10. Governing Law

11. Changes to These Terms
