Country and Regulatory Risk
- —Argentine legal system: Property law, foreign ownership regulations, and tax treatment can change by presidential decree, legislation, or administrative action with limited notice.
- —Ley de Tierras (Law 26.737): Restricts foreign individuals and entities from owning more than 1,000 hectares of "rural land" and imposes national limits on total foreign ownership per province.
- —Border zones: Properties within 50km of international borders require additional approvals from the Argentine Ministry of Interior.
- —Zoning changes: Municipal and provincial zoning classifications (FOS, FOT, Aptitud Ambiental) are set by ordinance and can change. Information on The Ark reflects documents available at the time of upload.
Currency Risk
- —Argentine Peso (ARS): Argentina has experienced significant inflation and periodic currency controls. While land transactions are typically denominated in USD, regulatory changes may affect the ability to remit funds internationally.
- —USD Controls: At various times, Argentina has imposed restrictions on USD purchases and international wire transfers.
- —Exchange rates: The official rate, blue rate, and financial dollar rate may differ significantly at any time.
Property-Specific Risk
- —Title risk: Even with a clean title certificate (Informe de Dominio), undisclosed encumbrances, easements, or historical claims may exist. Always engage an Argentine notary (escribano) to perform an independent title search.
- —Environmental risk: SMA and surrounding areas are subject to native forest protection laws (OTBN — Ley 26.331). Red and Yellow zones have construction restrictions. A green OTBN classification at time of listing does not guarantee it will remain green.
- —Infrastructure risk: Rural properties may lack road access, electricity, water, or internet connectivity. Access conditions can change seasonally.
- —Cadastral risk: Official cadastral data (Certificado Catastral) may not reflect the most recent survey. Boundary disputes with neighboring properties can occur.
Platform Risk
- —Data currency: Property documents on The Ark are uploaded at a point in time and may not reflect subsequent regulatory or cadastral changes.
- —3D data: Gaussian Splat files and orthophotos are captured at a specific date and may not reflect the current condition of the land.
- —Pipeline stage: The pipeline stage shown on a property reflects The Ark's internal document collection process — it does not represent a legal status or regulatory approval.
Liquidity Risk
Land in Patagonia is an illiquid asset. There is no public market for resale. Finding a buyer may take months or years. The Ark does not provide secondary market services.
Tax Risk
US citizens and residents are subject to US tax on worldwide income and gains, including gains from the sale of Argentine property. Argentine local property taxes (impuesto inmobiliario) and transfer taxes also apply. Tax treaties between the US and Argentina may affect your liability. Consult a tax professional in both jurisdictions.
